LABOUR MARKET IMPACT ASSESSMENT (LMIA) & LMIA - EXEMPT

To obtain a work permit in Canada, foreign nationals are generally required to have an offer of employment from a Canadian employer. Potential employers may need to complete a Labour Market Impact Assessment (LMIA) before applying for a work permit. An LMIA is used to prove that a foreign worker is needed for a specific job; no Canadian worker or permanent resident is available.

 

Some employees are eligible for LMIA-exempt work permits with the support of their employer. There are several programs that are LMIA-exempt. Among them are the French Mobility Program, intra-company transfers, and reciprocal work permits.

INTRA-COMPANY TRANSFER WORK PERMIT

The intra-company transfer takes place when an employee of an international company is deemed necessary for the organization's Canadian branch or location. The employee can then be transferred to the employer's Canadian location and permitted to work there. No LMIA is required for this transfer.

OPEN WORK PERMIT

With an open work permit, you can work in almost any occupation across Canada. It is possible to obtain an open work permit in several ways. A 25-year-old can apply if they wish to work and travel in Canada for a year, or a spouse of an international student may apply.

EXEMPT FROM A WORK PERMIT

Temporary workers are exempt from the requirements for obtaining a work permit as outlined in Canada's Immigration and Refugee Protection Act. You must meet specific requirements in order to be exempt from a work permit, including working in a specific occupation and receiving support from a Canadian employer.
